GETTING LEGAL with FIREWORKS and EXPLOSIVES

Lets get this out of the way first!  CONSUMER FIREWORK STORAGE:   People have asked us about the storage of consumer fireworks, which do not need to be stored in a federally approved explosive magazine. Being that we sell fireworks online, we are storing them for you, if you buy fireworks from us... You can arrange to pick up your fireworks at your convenience, within a reasonable amount of time. You cannot store fireworks purchased elsewhere here, we are usually stocked to the ceiling with consumer fireworks, especially during July 4th firework season.

There are areas of the country in which possession of fireworks are partially, or totally illegal. We do not know the laws in your state, county, or city. Check with your state Fire Marshal about the laws in your state and your local area. If you're purchasing fireworks from us to use here in Missouri or in your state the above paragraph covers the storage questions. We discourage you from attempting to take any fireworks into a state or area in which they are illegal.

 

WHAT IS CONTINGENCY STORAGE, and WHY YOU NEED IT?
"GETTING LEGAL"

Anyone that has or wants any type of explosive license from the BATFE, even to shoot a single firework show a year, must have a contingency storage plan before a license is issued. This is in the event that your show must be cancelled or you have left over unexploded product (s) that need to be stored.   *This explosive storage must be available during the entire term of your explosive license.* 

Say that you're planning to get a High Explosive manufacturing license and that you only plan on manufacturing items to test and use [play with :) ] on a single day. The BATFE will still require you to have a place to store your high explosives before a license will be issued. They will not accept the response of; I only intend to manufacture on site and never store anything.  If you plan on making fireworks most of the components must be made up ahead of time before final assembly. Each of these dry components must be stored in a magazine, as well as the finished firework.

It is relatively easy to get a federal license to manufacture and/or use professional fireworks and explosives.  If you are over 21, can pass a federal background investigation, have storage available, you can get an explosives license. If you wish to manufacture fireworks and/or explosives, you need a good reason and show some kind of experience, the BATFE will interview you and ask a lot of questions.  Within reason, a license will be issued unless you have no idea what you're doing, have been convicted of a felony, or have done some other stupid act. We will help you get your license if you have questions and need assistance. We have helped many people get both their state and federal licenses. It is a great feeling to get "completely legal" when making fireworks, and to have legal fun with explosives.

You only need a federal explosives license if you are, "engaged in business" of manufacturing. State laws are a whole different story, and are usually more restrictive (and expensive) than the federal laws.

MISSOURI HAS NO HOBBYIST PROVISIONS IN THE LAW!   Here in Missouri for example, the law requires that, "any person making, manufacture, assembly, or construction of fireworks of any kind within the state of Missouri,"  be a licensed manufacturer. But, ... before you can get the state license active you must also have a federal license. See the vicious circle? If you're outside the state of Missouri, you must first check with your state Fire Marshal about your regulations, we can then help you with the federal license. You just may find that you do not need a state license, which will greatly simplify your life. If you're not engaged in business then you're set, but you will still need an approved storage facility.

All manufactured fireworks and explosives must be stored in an approved magazine whether or not you are licensed.  All dry compositions must be stored in a magazine too.  If you make any firework, no matter how small, it is considered an explosive item that must be stored in a magazine. Only limited power fireworks that are "approved first" by the DOT do not need to be stored in an explosive magazine. Everything that you make that is not DOT approved will be classified as a either a 1.1, 1.2, or 1.3 explosive, requiring a storage facility.

HOW DOES FIREWORK and EXPLOSIVE STORAGE RENTAL WORK?

We maintain the magazines and the physical security, as well as put up with the federal and state regulations end of storage so that you don't have to go to the trouble and expense. The most expensive part of the license is buying, or making a legal storage magazine, and having enough property for the legal safety distances for the class and amount of explosives to be stored.

When you want to get an explosives Manufacturer or User license, or a change your storage to here, we will provide you with a letter stating that you have a contract with us for the storage of explosives in one of our magazines. The contract will have beginning and ending dates of storage availability for you to give to the BATFE with your license application. The BATFE will stop by here or call us to verify this information.

Even if you have a contract with us, you must contact us before bringing any explosive item, and also before picking up any explosive items. This is to insure that there will be someone here that can legally access the magazines. 

When brought here, your explosive product's will be placed in boxes, (they should be already) properly inventoried and labeled. You will have an inventory from where you purchased your explosives, but we will take our own inventory. We will make three copies of the inventory of your items. Your boxes will be shrink wrapped and an inventory will be taped to your products. The second copy of the inventory will be maintained in our office, and you will get a copy of the inventory to take with you. You will NOT  get a key to either our property or our magazines, only a BATFE authorized employee possessor can have these keys.

We have looked at individual locked boxes within each magazine, however the use of the metal locks, hasps, and hinges inside a magazine is prohibited. A fully inventoried and shrink wrapped "package" that has your name and inventory on it is more than sufficient to secure your products from our other customers' property.

 

HOW MUCH DOES EXPLOSIVE STORAGE COST?

We will not take month to month payments for explosive storage like a mini-storage does, except in emergency situations.
The best, and the cheapest way to get an explosive storage contract is for the entire term of your license.
 

LOW EXPLOSIVE STORAGE

You need to determine how much storage space that you will need. We have individual storage spaces that measure 8' wide, 10' long and 8' tall.  

We have found that the above space is more than sufficient for the average firework User licensee, or low explosive User. An active manufacturer may need more space for all the components for shells, as well as the finished shells.

For single use limited permit holders, and temporary emergency storage, each space rents for $80 for a two month period, and $45 a month for any part of a calendar month thereafter.  If your single show is during the months of June or July you must contact us to see if space is available. If your show is at other times of the year there is usually no problem with available space.

For most license holders each space is $240 a year ($20 a month), or pay $360 ($10 a month) for a 3 year period.

Rent more than one space if you need it. If you have need for a considerably larger storage space, let us know. We have space available for many thousands of pounds of explosives.

Low explosives examples are Black Powder, fireworks, stars for fireworks, and most compositions to manufacture fireworks and explosives. Any dry compositions or/and formula MUST be stored in an explosives magazine.
 

HIGH EXPLOSIVE STORAGE

We are in a real need of additional High Explosive storage for our own use. As this is being written our HE magazines are filled to capacity. Call or email us if you have a need for High Explosive storage. This will be on a case by case basis until additional magazines can be built. Obviously, High Explosive storage is more expensive than storing Low Explosives.

Examples of High Explosives are bulk salutes of any size, loose Flash Powder or Whistle Mix, Dynamite, Detonation Cord, and similar explosives.

 

NOTE THIS IMPORTANT INFORMATION

Let me tell you folks ... the DOT has NO SENSE OF HUMOR!  You have to get your fireworks/explosives here to be stored. The Department Of Transportation is a whole other can of worms! The information here is only for state and federal explosive laws and storage.

The DOT hazmat laws on explosives transportation are strange. If you are transporting fireworks for personal use, this is usually okay. Now, if you are transporting the same fireworks for "commerce" the rules change.  You can transport some explosives and fireworks for you to play with, but if you are intending to sell them, or use them for a "job," as in you're being paid to do a firework show, it's a whole new ball game. In other words if the government thinks that if you're making money ... they want more than their fair share of it! Lets give them a break a second. If you are using fireworks/explosives in commerce, then more than likely you will be transporting a lot more than the hobbyist!

We may get more into DOT laws in the future and put them here under "Getting Legal."  However, the scope of the regulations may make it too long to go into on this page.

DIRECTIONS

We are located in central southern Missouri, off of Highway 5. 
We are approximately 30-45 minutes from Interstate 44 and Lebanon, Missouri.
Approximately 15 minutes from Mansfield, Missouri and Highway 60

 

From Interstate 44 and Lebanon, Missouri

If you look at the maps below there is another way to our property from the North, but we have found that most people miss the turns on the dirt roads. It is not that much farther to follow the directions below.

Take highway 5 south, just before you reach the Hartville city limits, Highway Z, will be on your left.  Take Z to the left, on Z you will pass highway E.  Just past highway E the first dirt road to the left is Krause Rd.  Take the left on Krause.  Krause makes a series of curves, when you reach the straight section of Krause road we are a short distance up on the right. If you reach Ince Drive, you have gone too far. If you're on Krause Road you can't miss us.


From Branson, or Springfield, Missouri, follow either of the directions below.

From Interstate 44 and Marshfield, Missouri

Take highway 38 East to Hartville. (It is along this road that received the brunt of the areas tornado damage. There may be crews still cleaning up by the road.) Use extreme caution on this road, there is semi-truck traffic, as well as horse and buggy traffic, narrow bridges, and one lane bridges. When you get to the intersection of 38 and 5 in town, our only flashing light, make a left, North on highway 5.  North on 5, just past the city limits on your right is highway Z.  Take Z to the right. Just past highway E the first dirt road to the left is Krause Rd.  Take the left on Krause.  Krause makes a series of curves, when you reach the straight section of Krause road we are a short distance up on the right. If you reach Ince Drive, you have gone too far. If you're on Krause Road you can't miss us. 

 

From Highway 60 Mansfield, and Ava, Missouri.

Take highway 5 North to Hartville. You will pass highway 38 in town, our only flashing light! Continue North on 5, just past the city limits on your right is highway Z.  Take a right on Z. Just past highway E the first dirt road to the left is Krause Rd.  Take the left on Krause.  Krause makes a series of curves, when you reach the straight section of Krause road we are a short distance up on the right.
